The general terms and conditions of sale detailed below govern the contractual relationship between any user of the site matindemaitre.fr (\u201cthe Customer\u201d) and the online sales company De Main de Ma\u00eetre (\u201cthe Site\u201d).<\/p>\n

These general conditions of sale are the only ones applicable and replace all other conditions, except prior, express and written derogation. Any purchase on the Site is subject to all the clauses of the General Conditions of Sale. The Customer will only be able to validate his order after having duly read them and having accepted them by ticking the icon dedicated to this purpose.<\/p>\n

By validating the General Conditions, the Customer declares to have the legal capacity allowing the conclusion of a contract within the meaning of articles 1123 and following of the French Civil Code. The Customer must guarantee the truthfulness and accuracy of the information provided and use the site in accordance with the general conditions of sale. De Main de Ma\u00eetre reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.<\/p>\n

  1. Products and definitions <\/strong><\/li>\n<\/ol>\n

    Les produits vendus sur le Site sont des reproductions d\u2019\u0153uvres d\u2019art libres de droit du domaine public, modifi\u00e9es \u00e0 l\u2019aide d\u2019outils num\u00e9riques, imprim\u00e9s sur divers supports, rehauss\u00e9s \u00e0 la main ou non, et encadr\u00e9s ou non. Le rehaussage \u00e0 la main est une technique artisanale, non m\u00e9canique, donc susceptible de substantielles variations en termes de rendu. Ces variations ne sauraient  donc \u00eatre une cause d\u2019annulation de vente. Ces reproductions sont propos\u00e9es dans plusieurs formats, sur plusieurs supports. Les photographies et images repr\u00e9sentant les oeuvres sont pr\u00e9sent\u00e9es \u00e0 titre d’illustration, et ne sont pas contractuelles. <\/p>\n

    De Main de Ma\u00eetre propose \u00e0 ses clients un service suppl\u00e9mentaire d’encadrement \u00e0 petit co\u00fbt. Les cadres sont donc un service r\u00e9serv\u00e9 aux clients ayant command\u00e9 une ou des reproductions. Ils ne sont pas vendus s\u00e9par\u00e9ment, et il est demand\u00e9 au client lors de son processus d’achat de confirmer qu’il a bien \u00e9galement command\u00e9 une reproduction, faute de quoi l’achat de cadre n’est pas possible. Toute commande de cadre sans commande simultan\u00e9e de reproduction sera donc annul\u00e9e.<\/p>\n

    1. Price<\/strong><\/li>\n<\/ol>\n

      The prices are indicated inclusive of all taxes, excluding shipping costs. Only payments in euros are accepted on the Site.<\/p>\n

      The price to be paid may be reduced by a discount (for example coupons or vouchers). The price will not be final until the order is confirmed.<\/p>\n

      De Main de Ma\u00eetre reserves the right to modify its prices on the site at any time. The products will be invoiced on the basis of the rates in force at the time of the registration of the order.<\/p>\n

      The products remain the property of De Main de Ma\u00eetre until full payment of the price indicated.<\/p>\n

      In the event of a change in the VAT rate, the price will be automatically changed without notice other than the legal date of payment of the new rate.<\/p>\n

      1. Order process<\/strong><\/li>\n<\/ol>\n

        In order to place an order, the customer must follow the following steps:<\/p>\n

        • Viewing a product page. On this page, the customer will have to choose: the reproduction, its size according to the sizes available as well as possibly a frame if he wishes.<\/li>\n
        • Click on the "add to cart" button. The customer can then go directly to payment or continue shopping on the site.<\/li>\n
        • Cart page: The customer can delete an item or modify the quantities ordered.<\/li>\n
        • Address page where the customer can choose their delivery and billing addresses<\/li>\n
        • Delivery choice page.<\/li>\n
        • Payment page: the customer can use his reduction coupon if he has one, select his means of payment and check the various elements constituting the order.<\/li>\n<\/ul>\n

          The customer must then accept these general conditions of sale to confirm the order and proceed to payment according to the chosen method. Their acceptance is made by ticking the box in front of the link to these conditions.<\/p>\n

          The order is effective upon confirmation of payment by the bank, which will be notified to the customer by email.<\/p>\n

          1. Means of payment and security<\/strong><\/li>\n<\/ol>\n

            Several means of payment are available on the site:<\/p>\n

            • Credit Card: Visa, Mastercard, and others.<\/li>\n
            • PayPal<\/li>\n
            • Amazon Pay<\/li>\n<\/ul>\n

              Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa). Secure online payment by bank card is made by our payment provider. The information transmitted is encrypted in the state of the art and cannot be read during transport on the network.<\/p>\n

              For every bank transaction (credit card, Visa, Mastercard) the bank transaction carried out on the site is processed and secured by Stripe for Woocommerce, Stripe's payment platform.<\/p>\n

              Credit card payments are entirely processed on Stripe's secured servers.<\/p>\n

              In the case the customer choose Paypal or Amazon Pay as the payment method, he is redirected on Paypal or Amazon respective servers, where the transaction is processed and secured.<\/p>\n

              De Main de Ma\u00eetre never has access to your banking information. In addition, all information is encrypted using the SSL protocol and cannot be intercepted or modified.<\/p>\n

              Once the payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating his banking information during the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the Sale is immediately resolved as of right and the order cancelled.<\/p>\n

              De Main de Ma\u00eetre cannot be held liable for damage resulting from the use of electronic means of communication, including \u2013 but not limited to \u2013 damage resulting from failure or delay in the transmission of electronic communications, the interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and for the transmission of viruses. The means of payment offered by the site are likely to vary according to, for example, their popularity or customer demand at the sole discretion of the Site.<\/p>\n

              1. Delivery<\/strong><\/li>\n<\/ol>\n

                Shipping costs are based on the size and weight of your order.<\/p>\n

                De Main de Ma\u00eetre works in partnership with Colissimo.<\/p>\n

                The Customer must carefully fill in all the fields of the delivery form at the time of the order, including his delivery details and a telephone number. De Main de Ma\u00eetre cannot be held responsible for a delivery failure due to an inaccuracy or error in the delivery address.<\/p>\n

                Delivery times are approximately 8 working days on average. Due to the manufacture on demand of the Products, these deadlines are likely to vary and De Main de Ma\u00eetre cannot be held responsible for this. In any case, the delivery time of the Products will not exceed four (4) weeks from the receipt by the Customer of the confirmation of his order.<\/p>\n

                Prices and shipping costs are indicated in Euros. The price is payable in full and in a single payment when ordering. All orders are invoiced and payable in Euros only. For any delivery outside Metropolitan France, any customs fees or local taxes are the responsibility of the recipient.<\/p>\n

                Our product offers and prices are valid as visible on the site, within the limits of available stocks. For products not manufactured by De Main de Ma\u00eetre, our offers are valid subject to availability from our suppliers. This information coming directly from our suppliers, errors or modifications may exceptionally occur.<\/p>\n

                The customer can follow the progress of his order from his Colissimo tracking number. All the customer has to do is connect to the Colissimo site to track their delivery in real time.<\/p>\n

                De Main de Ma\u00eetre delivers worldwide with Colissimo. For any specific question and delivery outside mainland France, please contact our customer service by email at contact@demaindemaitre.fr. Our customer service will establish a personalized delivery quote for shipments outside mainland France.<\/p>\n

                In the event of late delivery beyond thirty (30) days, the Customer has the option of terminating the contract under the terms and conditions defined in Article L 216-2 of the Consumer Code. The Seller then reimburses the product and the \u201cone-way\u201d costs under the conditions of the provisions of Articles L216-3 and L241-4 of the Consumer Code.<\/p>\n

                  \n
                1. Availability and presentation <\/strong><\/li>\n<\/ol>\n

                  In the event of the unavailability of an article for a period of more than thirty (30) working days, you will be immediately notified of the foreseeable delivery times and the order for this article may be canceled on simple request. The Customer may then request a credit note for the amount of the item or its full refund and cancellation of the order.<\/p>\n

                  In the event of unavailability of products from our suppliers after placing your order, we will notify you by email as soon as we learn of it. If you refuse a replacement solution for equivalent equipment, your unavailable order will be automatically canceled and you will be refunded if your bank account has been debited.<\/p>\n

                  1. Receipt of delivery and right of return<\/strong><\/li>\n<\/ol>\n

                    The Seller recalls that when the Customer takes physical possession of the products, the risk of loss or damage to the products is transferred to him. Upon delivery, the buyer is required to check the goods. Any reservations he intends to make on the condition of the goods delivered must be mentioned on the delivery note.<\/p>\n

                    In the absence of mention on the delivery note, no complaint will be accepted after receipt of the goods, except in the event of a hidden defect.<\/p>\n

                    1. force majeure<\/strong><\/li>\n<\/ol>\n

                      De Main de Ma\u00eetre cannot be held responsible for any delay or impossibility in processing a customer's order arising from one or more external events beyond its control and control and which are reasonably insurmountable, defined as Force Majeure Events as defined by applicable law and the items below.<\/p>\n

                      Should be considered as events of force majeure, in particular, the destruction of equipment, computer attacks or hacking, the deprivation, deletion or prohibition, temporary or definitive, and for any reason whatsoever, of access to the Internet network and the cases recognized according to case law.<\/p>\n

                      1. Cancellation and withdrawal<\/strong><\/li>\n<\/ol>\n

                        In accordance with Article L121-20 of the Consumer Code, the customer has a right of withdrawal, without giving any reason, to return a work within fourteen (14) days after the order confirmation. This right does not apply to orders for gift vouchers or to orders placed by companies.<\/p>\n

                        In the event of exercise of the right of withdrawal within the aforementioned period, the price of the product(s) purchased and the shipping costs will be refunded, the return costs remaining the responsibility of the Customer. Returns of products must be made in their original condition and complete (packaging, accessories, instructions, etc.).<\/p>\n

                        In this case, the customer will contact De Main de Ma\u00eetre by e-mail at contact@demaindemaitre.fr indicating CANCELLATION in the subject of the e-mail.<\/p>\n

                          If the returned product is in its original condition, the refund period is a maximum of 30 days from the date of receipt of the product by De Main de Ma\u00eetre. Reimbursement will be made by bank transfer to the account used for payment.<\/span><\/p>\n

                          1. Warranty and Liability<\/strong><\/li>\n<\/ol>\n

                            De Main de Ma\u00eetre reserves the right to correct, at any time and without notice, the content and information published on the site. Despite our best efforts to be as precise and accurate as possible, De Main de Ma\u00eetre does not guarantee the accuracy and correctness of this information (including but not limited to descriptions of works, artist biographies, dates ).<\/p>\n

                            De Main de Ma\u00eetre declines all responsibility for any interruption of the site, any occurrence of technical problems, any inaccuracy or omission relating to the information available on the site, any damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the site.<\/p>\n

                            De Main de Ma\u00eetre cannot be held responsible for problems of access or third-party site content.<\/p>\n

                            De Main de Ma\u00eetre will not be liable for damages arising from the use or inability to use the Site or malfunctions attributable to third-party software incorporated into the site.<\/p>\n

                            The choice and purchase of a product are the sole responsibility of the customer.<\/p>\n

                            1. Consumer information<\/strong><\/li>\n<\/ol>\n

                              For consumer information purposes, the provisions of the Civil Code and the Consumer Code are reproduced below:<\/p>\n

                              Article 1641 of the Civil Code<\/em> : The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unsuitable for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid less if he had known them.<\/p>\n

                              Article 1648 of the Civil Code<\/em> : The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. In the case provided for by article 1642-1, the action must be brought, on pain of foreclosure, within one year following the date on which the seller can be released from the apparent defects or lack of conformity.<\/p>\n

                              Article L. 217-4 of the Consumer Code<\/em> : The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility.<\/p>\n

                              Article L. 217-5 of the Consumer Code<\/em> : The good is in conformity with the contract: 1\u00b0 If it is suitable for the use usually expected of a similar good and, if applicable:<\/p>\n
